Extension of Visitors Pass (ETA)
A Visitor’s Pass Extension in Kenya is an authorization granted by the Directorate of Immigration Services (Kenya) allowing a foreign national who entered Kenya on a Visitor’s Pass (eTA) to legally remain in the country beyond the initial period granted at Point of Entry (Airport, Seaport or Landport). Extension of Stay under Regularization
An “Extension under Regularization” in Kenya is an immigration compliance mechanism used to temporarily extend a foreign national’s stay while they are in the process of correcting or formalizing their immigration status. The Kenya Immigration and Citizens Act requires all foreigners within Kenya to abide by the Immigration rules by being in the Country lawfully. In Kenya, Passes are temporary authorities and statuses granted to foreign nationals to engage in different engagements while residing in Kenya. Kenya Dependant’s Pass (KDP)
This is a document issued to a person whose spouse, child, parent or guardian is lawfully entitled to enter and remain in Kenya in accordance to the Kenya Citizenship and Immigration Regulations, 2012 Section 27 (1). For children the age limit is 21 years except for those in full time education institute or mental and physical incapacity.
Kenya Special Pass (KSP)
This is a document issued under Regulation 34 of the Kenya Citizenship and Immigration Regulations, 2012, to person(s) who wishes to enter or remain in Kenya for a limited period of up to 6 months for purposes of temporarily conducting a business, trade or profession. Prohibited immigrant pass is also issued for the purpose of appealing a decision.
Kenya Student’s/Research/Internship passes.
This is a document issued to applicants (foreign students) according to Section 30(1) of the Kenya Citizenship and Immigration Regulations 2012, who wish to pursue their education in Kenya’s Education system or Training Institutions where they have been accepted or admitted.
Kenya Re-Entry Pass
A Kenya Re-Entry Pass is an official immigration Authority issued by the Directorate of Immigration Services (Kenya) that allows a foreign national who is legally residing in Kenya under a Dependant Pass to leave and re-enter the country multiple times without losing their immigration status or being required to pay for eTA/visa. In Kenya, a Work Permit is a document issued by the Directorate of Immigration Services, under the provisions of section 40 of the Kenya Citizenship and Immigration Act, 2011, to enable foreign national (s) enter Kenya and engage in trade, prospecting, farming, business, professional employment, missionary activities or even reside in Kenya.
The Directorate issues Work/Residence permits upon the recommendation of the Permit Determination Committee, an inter-ministerial Committee appointed by the Cabinet Secretary Ministry of Interior and Coordination of National Government under section 40(1) of the Kenya Citizenship and Immigration Act, 2011.
Any person aggrieved by the decision of the Director regarding work/residence permit applications, may appeal to the Cabinet Secretary, for review of the decision (section 22(1) of Kenya Citizens and Foreign Nationals Management Service Act, 2011).
Our consultants provides permit processing services under the various classes of permits as provided for under Section 36(1) and as read with the seventh schedule of the Kenya Citizenship and Immigration Regulations, 2012 as listed below:-
Permit Class A: (for prospecting and mining)
This permit is issued to a person who intends to engage, whether alone or in partnership, in prospecting for minerals or mining in Kenya.
Class B: (Agriculture and Animal Husbandry)
This permit is issued to a person who intends to engage, whether alone or in partnership, in the business of agriculture or animal husbandry in Kenya.
Class C: (Prescribed profession)
This permit is issued to a person who is a member of a prescribed profession who intends to practice that profession, whether alone or in partnership, in Kenya.
Class D: (Employment)
This permit is issued to a person who is offered specific employment by a specific employer, the government of Kenya or any other person or authority under the control of the Government or an approved technical aid scheme under the United Nations Organization or some other approved Agency (not being an exempted person under section 34 (3), who is in possession of skills or qualifications that are not available in Kenya and whose engagement in that employment will be of benefit to Kenya.
Class F: (Specific manufacturing)
This permit is issued to a person who intends to engage, whether alone or in partnership, in a specific manufacture in Kenya.
Class G: (Specific Trade, Business or Consultancy)
This permit is issued to a person who intends to engage, whether alone or in partnership, in a specific trade, business, consultancy or profession (other than a prescribed profession) in Kenya.
Class I: (Approved religious or Charitable activities)
This permit is issued to a person who is a member of an institution registered under the Society’s Act who is engaged as a missionary, Member of a company limited by guarantee, Member of a trust registered under the Trustees Act and is approved by the Government of Kenya, and whose presence in Kenya will be of benefit to Kenya.
Class K: (Ordinary residents)
This permit is issued to a person who Is not less that thirty-five years of age; and has in his own right and at his full and free disposition an assured annual income of not less than the prescribed amount that is derived from sources other than any such employment, occupation, trade, business or profession as is referred to in the description of any of the classes specified in this Schedule.
Class M: (Refugees)
This permit is issued to a person who has been granted refugee status in Kenya in accordance with the refugee law of Kenya and any spouse of such a refugee who intends to take up employment or engage in a specific occupation, trade, business or profession.
Class N: (KEP/N) Digital Nomads
This permit is issued to a person who works remotely within Kenya for a company registered outside the country.
Class P: (KEP/P) Staff of United Nations, Diplomatic Missions, Inter-Governmental Organizations, and International Non-Governmental Organizations.
This permit is issued to staff of the UN, Diplomatic Missions, Intergovernmental Organizations or International non-governmental organizations, accredited to neighboring hardship countries and staff based in hardship neighbouring countries of such organizations.
Class Q: Professionals working for religious or charitable organizations (KEP/Q)
This permit is issued to a person who is a member of prescribed professional and working for religious or charitable organizations and who is not involved in preaching or the conduct of religious worship and rituals and whose presence will be of benefit to Kenya
Class R: EAC NATIONALS (KEP/R)
This permit is issued to a person who is a citizen of a Member State of the East African Community and is not a Prohibited Immigrant and who intends to reside, engage in employment, activity, business, trade or engage in any prescribed profession and whose presence will be of benefit to Kenya.
Exempted permit
An Exempted Permit in Kenya is issued to any person or class or description of persons, exempted by the cabinet secretary from provisions of obtaining a work permit by notice in the gazette. (Section 34 (3)(g) of the Kenya Citizenship and Immigration Act, 2011).
The Kenyan Permanent Residency is an authority or status granting a foreign national leave to remain in Kenya indefinitely unless he contravenes section 39 of the Kenya Citizenship and Immigration Act, 2011. There are four categories of applications that can be made under Permanent Residency. These are provided under Section 37 of the Kenya Citizenship and Immigration Act, 2011.
Category A: (Permanent Residency by Ex-Citizens of Kenya)
This category applies to applicants who were Kenya citizens by birth but have since renounced or lost citizenship status and/or are denied the opportunity by their countries of domicile to hold dual citizenship. Children and spouses of these applicants can also apply.
Category B: (Permanent Residency by holders of Work permits)
This category applies to applicants who have held Kenya work permits for at least 7 years and have been continuously resident in the country for three years immediately preceding the permanent residence application. It also includes their spouses and children.
Category C: (Permanent Residency by Children of Kenya Citizens)
This category applies to Children of Kenya Citizens born outside the country and have acquired foreign citizenship of their country of residence/domicile.
Category D: (Permanent Residency by Spouses of Kenya Citizens)
This category applies to Spouses of Kenya Citizens married for at least three years.
We support applicants seeking to register as citizens of Kenya through the Kenya Citizenship and Immigration Act, 2011 that implements Chapter 3 of the Constitution of Kenya on issues of citizenship.
Dual Citizenship; this is a declaration made by a dual citizen.
Citizenship Endorsement; this is an application by a dual citizen for endorsement on non-Kenyan passport.
Regaining Kenya Citizenship; this is an application to regain Kenya citizenship.
Citizenship by Marriage; this is an application for registration as a citizen of Kenya by a spouse of a Kenyan citizen.
Widows and Widowers; this is an application for registration as a citizen of Kenya by a widow/widower of a Kenyan citizen.
Lawful Residents; this is an application for registration as a citizen of Kenya by Lawful Residents.
Children/Adopted Children; this is an application for registration as a citizen of Kenya for a child.
Persons with Disability; this is an application for registration as a citizen of Kenya for a child/person with disability.
Stateless Persons; this is an application for registration as a citizen of Kenya by a stateless person.
Migrants; this is an application for registration a a citizen of Kenya by migrants.
Descendants of Stateless Persons and Migrants; this is an application for registration as a citizen of Kenya by a descendant of stateless/migrant.
Voluntary Renunciation of Kenyan Citizenship; this is a declaration of voluntary renunciation of Kenyan citizenship.
Registration as a Foreign National previously known as an Alien and now commonly known as Foreign National Card is a mandatory legal process requiring certain non-citizens residing in Kenya to be formally registered and issued with an identification document by the Directorate of Immigration Services (Kenya). Registration of foreign nationals is governed by the Kenya Citizenship and Immigration Act of 2011 Part VII (56) 2 Laws of Kenya. The Law requires that all foreigners’ resident within Kenya for a period exceeding 90 days be registered. Part 1 of the newly enacted Kenya Citizenship and Immigration Act 2011 defines a foreign national as any person who is not a citizen of Kenya. A foreign national’s registration certificate shall be valid for a period not exceeding two (2) years. In case of a Permanent Residence holder, the certificate shall not exceed three (3) years.
